General Terms and Conditions Bikeguide-Tirol.At regarding the organisation of guided MTB, E-MTB, gravel bike or road bike tours and riding technique training.
(Hereafter referred to as tour/training.)
These General Terms and Conditions apply to all current and future contracts concluded between Bikeguide-Tirol.at and its customers regarding the organisation of a tour/training.
Any general terms and conditions of the customer that deviate from these general terms and conditions or amendments or additions to these general terms and conditions require the express written consent of Bikeguide-tirol.at in order to be valid
The customer must register for a tour/training in writing using the booking form, e-mail, WhatsApp or SMS. The registration is binding for the full number of persons registered. The registering customer declares that he/she also recognises the GTC on behalf of the other registered travellers.
The participation fee is to be paid by the participant directly to the organiser. Payment shall be made by bank transfer or in cash before the start of the tour/training. The customer is only entitled to take part in the tour/training once full payment has been received.
The customer is entitled to withdraw from the tour/training at any time against payment of a flat-rate compensation fee (cancellation fee). This is calculated as follows: within 120 hours (or 5 days) before the start of the tour/training 20%, within 72 hours before the start of the tour/training 50%, within 24 hours or up to the closing time of the previous day at the latest 75%.

In this case, Bikeguide-tirol.at undertakes to refund any payments already made less the flat-rate compensation (cancellation fee) within five days.
Whether a tour/training cannot be carried out due to weather conditions will be decided by the guide exclusively on site, approx. 15 minutes before the planned start of the tour/training. In the event of a weather-related cancellation by participants, no refund will be made. A voucher of the same value for an alternative date can be issued at the express request of the customer.
If Bikeguide-tirol.at has to cancel the tour/training for reasons for which it is responsible, the price will be refunded. This also applies in particular to cancellations due to failure to reach the minimum number of participants, provided that the cancellation is made within 24 hours before the start of the tour/training or at the latest by the close of business on the previous day.
If the cancellation is due to force majeure, i.e. due to unusual and unforeseeable events over which bikeguide-tirol.at had no influence and the consequences of which could not have been avoided despite exercising due care, bikeguide-tirol.at may also cancel the tour without being subject to any claims for compensation. Such events include, for example, government orders, strikes, war or warlike conditions, natural disasters, etc.
Only those who are fully fit to ride can take part in riding technique training and tours. Any impairment of fitness to ride, in particular due to alcohol, drugs or medication, will result in exclusion from the riding technique training or tour without entitlement to a refund of the participation fees and, in the event of a later discovery, to the loss of any claims for damages
Participants are obliged to wear a bicycle helmet during the riding technique training or the tour. Without a bicycle helmet, the participant will be excluded from the course or tour; in this case, there is no right to a refund of the participation fee. Furthermore, the participant is fully responsible for the technical safety of his/her bicycle during the entire riding technique course or tour.
As a participant in guided training courses and tours, it is necessary to follow the instructions of the guide at all times in order to ensure the highest possible level of safety for the entire group.
Mountain biking, e-biking, gravel biking and road biking are high-risk sports. Guides try to minimise this risk. However, there is always a residual risk. Every participant recognises these risks and dangers and always acts on their own responsibility and realistic self-assessment.
Participants therefore waive the assertion of tortious and contractual claims - except in cases of intent or gross negligence on the part of the organiser - against the organiser. This includes both personal injury and damage to property. By participating, you confirm that you are participating in the riding technique courses or tours exclusively at your own risk. It should be noted at this point that the organiser does not provide any separate accident or liability insurance for participants.
Except in cases of intent or gross negligence, the participants mutually waive compensation for any accidental damage, insofar as this cannot be compensated by any insurance benefit.
Each participant is responsible for his/her own equipment and a technically perfect mountain bike.
As the organiser, we reserve the right to exclude participants from the event whose mountain bike is not maintained and represents a risk for the rider. In this case, however, there is no entitlement to a refund of the amounts paid.
Your own technical, physical and fitness ability is part of a realistic self-assessment. In particular, there are different physical requirements for multi-day tours, for example, than for technical training sessions lasting several hours.
In the case of a voucher purchaser, the purchaser is legally responsible for ensuring that the voucher holder (i.e. technical training or tour participant) has read and accepted the terms and conditions on the Heylen Rob website www.bikeguide-tirol.at.
During the tour or riding technique training, photos or videos are taken by the guide or a person authorised by the guide. The participant may be depicted on the photos and recognised as a person. The participant agrees to the use of photos and/or videos taken on the tour/riding technique training and on which the participant may be recognisable for advertising purposes (for homepage, flyers, social media e.g. Instagram).
If the participant does not agree to this, he/she must expressly inform the guide before the start of the tour/training.
The participation of persons under the age of 16 requires the written consent of their legal representative (parents, parent, other legal representative). Only a written declaration from the legal representative will be accepted as consent.
Amendments and/or additions to this contract must be made in writing.
